Many riders suffer catastrophic injuries. Many bicycle accidents are deadly. According to the National Safety Council, there were 1,260 preventable bicycle fatalities in 2020 and 325,173 preventable injuries in 2020. New Jersey Spotlight News reported that as of December 17, 2021, 22 bicycle riders died in traffic accidents in New Jersey – the highest number since 1989.

The person primarily responsible for your bicycle accident, or a bicycle accident that took the life of a loved one, is the driver of the car or truck that caused the accident.
In some cases, other defendants may also be responsible. These defendants include:
- Employers, such as when a delivery driver causes a bicycle accident
- The owners of the car if different than the driver, such as when parents give their child permission to use their vehicle
- The manufacturers of defective bicycle parts
- The New Jersey Department of Transportation or another state agency/entity that had responsibility for the design of maintenance of the road
We’ll explain if, when, and how a bicycle rider can use a UM/UIM policy if the driver who caused the accident is a hit-and-run driver or who doesn’t have enough insurance to pay for your personal injury or wrongful death damages.
What New Jersey laws regulate bicycle riding?
Some of the laws that regulate riding a bicycle in New Jersey include the following:
- If you ride your bicycle at night, you’ll need a front headlamp that emits a white light, a rear lamp that emits a red light, and a rear reflector.
- You need a bell or audible device (not a whistle or siren).
- “A bicycle must be equipped with a brake that can make wheels skid while stopping on dry, level, clean pavement.”
- Bicycles must be equipped to carry passengers if you want someone on your bicycle.
- Rights and duties. Riders who ride their bicycles on roadways are granted rights as motor vehicle drivers and must comply with the same duties.
- Bicycle operation. There are rules for how riders on roadways can ride in each lane and turn left (such as to pass a slower-moving vehicle, avoid debris or hazards, and other conditions). Riders need to ride in the same direction as cars.
- Anyone under 17 who rides a bicycle or is a passenger must wear a properly fitted safety helmet. Some exemptions may apply for riding on trails that are exclusively for bicycles.
A parent may be held responsible for the child’s violation of any traffic law.
Drivers must comply with New Jersey’s Safe Passing Law, Title 39:4-92.4, when approaching a bicycle, a low-speed bicycle, or other approved conveyances.
There are additional rules for electric bicycles.
