What is a wrongful death action?
New Jersey Revised Statutes § 2A:31-1 provides the right to file a wrongful death claim. The law states that if the negligence of others causes the death of a member of a family and your family member would have been entitled to file a personal injury action had they lived – then the family has the right to file a wrongful death action against the wrongdoers.
At Ferrara & Gable, we understand the unique challenges involved in filing a wrongful death action and how wrongful death lawsuits differ from personal injury actions:
- Proving how the accident happened. Since your loved one can’t testify due to his death, our Pennsauken wrongful death lawyers work with the police, investigators, eyewitnesses, traffic reconstruction experts, nursing home professionals, and others to show how the deadly accident happened and who should be held liable.
- Coordinating your wrongful death case with any criminal charges. The police may file criminal charges such as driving under the influence (DUI) charges if the death of your loved one was more than just an accident. When there are criminal charges, we work with the prosecution. We generally work to either introduce the conviction into evidence or use the same evidence, such as the results of a breathalyzer test, to help establish the drunk driver’s liability.
- Filing a survivor claim. A survivor claim could be filed on behalf of your loved one’s estate if your family member survived the accident long enough to experience pain and suffering and for there to be medical bills to try to save your family member or make your loved one comfortable. At Ferrara & Gable, we coordinate the survivor claim with the wrongful death claim.
The people who can file a wrongful death claim are:
- The executor named in the will – if your loved one had a will
- An administrator of your loved one’s estate – if your loved one died without a will.
Who are the beneficiaries of a wrongful death claim in Pennsauken?
The beneficiaries of a wrongful death action are the people who receive benefits from the wrongful death verdict or settlement. The beneficiaries are determined by New Jersey’s intestate laws. Generally, the beneficiaries are the decedent’s spouse, parents, and children. Siblings may be entitled to the proceeds if there are no spouses, parents, or children. At Ferrara & Gable, we’ll explain who the beneficiaries are and what shares they receive.

What damages can be awarded in a New Jersey wrongful death case?
While no amount of money can ever bring your loved one back, wrongful death lawsuits provide compensation for family members so they fulfill the dreams your loved one had for each family member. Wrongful death damages help bring closure by holding the wrongdoers accountable and helping wrongdoers understand they need to prioritize safety so others aren’t harmed or killed.
In New Jersey, wrongful death damages include:
- The funeral and burial costs.
- The loss of income your family member would have provided each family member.
- The value of any household services, such as the cost to clean the family home that your loved one would have done for free.
- The loss of love, guidance, companionship, and education that your loved one would have provided each family member
We work with financial experts who are skilled at analyzing these damages. These experts review your loved one’s life expectancy, work experience, family relationships, and other factors to help arrive at a proper value for your claim.
